ok,
I just called and talked my way into getting the phone number for the courts. spoke to a lady and then she made the mistake to connect me thru to the Motion ATTorney Sections, where I spoke with a young lady, who I think thought I was part of the defense team that requested the Stay. here is the number, before she transferred me to the Motions sections, I asked her for the direct line number and she gave it to me. here it is listed below.
Motion Attorney Sections ( 415 ) 355- 8020
Stay # 11-55169 case number U.S court of appeals ninth circuit
please put this information out to anyone and everyone and bombard the phone lines. You will not believe what this girl told me. I think she thought I was for the SEC/DOJ as she revealed that a judges ruling normally takes up to 2-3 months
let me say that again 2-3 months. After she said that to me, I started to go off on her about how could this be and why in the first place was this allowed to happen and many other things to her....LOL
well, after that she was upset, started asking me like which party to the case are you for, and then says I cannot reveal any information to you unless I'm a plaintiff to the case, etc. etc. then goes on to tell me that she should have not told me the answer that it takes up to 2-3 months. She was only legally obligated to tell me what was on pacer only. BUT she made that mistake.
Imagine that. 2-3 more months. I can only hope that Al or someone will be explaining this to the shareholder base.
I was shocked to hear her say 2-3 months. I'm no lawyer but assumed it would be 7-14 days for a ruling just as if when both sides present their briefs and then Judge rules by 14 days later.
This is extremely disturbing and can only hope that you all do something about it and put this post or the info out on all boards and flood that phone number and demand the Judge make a ruling immediately. here is the number again ( 415 ) 355-8022
please take action and demand the judge make the ruling now.

I do not believe that calling them would be wise and it would make us look like a bunch of idiots because the office is not the ones who make the final call. I guess you are trying in your own way to get the word out but you kinda weren't completely honest with that lady and anything she said she thought was going to a lawyer so that is not honest or nice. We will learn nothing, make them mad and she can get in trouble. Good on ya for trying to learn something and trying but putting out the number and asking for shareholders to call will not help us.

DD
my point in this entire issue is the simple fact that she stated 2-3 months. We are all lurking waiting thinking that a decision will be made within 14 days and pretty much any minute, any hour, and day and for sure before 14 days is what i was thinking since the judge if he read both opening briefs would decide in 14 days, now all of a sudden it is 2-3 months. this is the biggest point to my passing this information on here.
now, does that mean that Al Hodges or someone thru Al Hodges needs to address this issue and explain that this could take 2-3 months for a judges ruling. Absolutely does he need to address this to the CMKX shareholder base so we are not once again searching, lurking, waiting for that decision, similar to when we were all told on Oct 19th, 2010, any minute, any hour, any day in all the Highest Authority silliness when again the shareholder base was stressed out and seeking answers, waiting for this so called info. it is the same exact scenario once again and needs to be addressed.

I agree that flooding the office with calls from irate shareholders will do us no good, and could potentially make the decision go against us.

Sirius she's just a clerk and only knows what is standard proceedure, which may not apply in this case. she does not know what their game plan is or private discussions she only knows standard proceedure. I know you wanted to gain info but you lied to get it and maybe hurt her job or position. us calling the office only hurts us because it shows that we don't know how to deal in a honest business manner now we all look bad. and jjust because you got some info which may apply to us or may not apply to us doesn't mean the ends justifies the means because we will all be looked upon as idiots. this is plastered on the boards and I hope people are more respectful of the clerk and judge's office then you've encouraged them to be. we have to be smarter imho. I did not think that this would be cleared in 14 days, really do not know when it will be cleared but just have to wait the thing out the other stuff is just talk and has to be taken with a grain of salt.

diamond dust,
i did not lie about anything. Also I'm pointing out that the judge will not answer this for 2-3 months, which has never been discussed by anyone and now you are posting you did not thing that a decision would be cleared in 14 days.
ok, as for calling or flooding the phone lines I can agree to that or at least see the arguments to that. My real concern is about the shareholders on edge, every minute, day hour waiting for the decision from the judge, where it was never talked about taking a along time to get an answer to wether or not Al hodges would be allowed to file his opening brief, which the judge agreed to the 30 day delay. No one ever expected a 2-3 month delay on that answer and if all true, then my main point is that we as a shareholder base, need to hear from Al Hodges or someone thru him about this 2-3 month process.
so again the main point was
1. to make people aware of the 2-3 month delay 2. to demand someone tell the shareholder base of this delay ( Al or thru Al H. ) 3. to call in and voice your concerns, which are legitimate, how the hell on earth can their be a 2-3 month delay, when oif that same judge is given opening briefs from both sides, have to respond and make ruling within 14 days.
makes no sense hence the posting to call in and voice concerns.
ok, so I can agree with that maybe not being the greatest idea, but what about 1-2. or are we going to have another Oct 19th, 2010 Highest Authority non- sense of the shareholder base waiting, lurking, searching each day, hour for this Judge's decision that could take 2-3 months.
so feel freee for some of you to discuss those issues as well.

ok, so the post above was from about 2 months ago. I spoke to that lady on phone and she was dead on 100% correct that it would take 2-3 months
well it took just over 2 months to get the response from the judge.
ok so we follow it again with dates again
DEC 5th, 20111 filing by Hodges Jan 4th 2012 for the SEC response
up to 14 days later we get the ruling from the Judge
ok.... just wanted to dig up this old post as the lady and the info was dead on

ok so not sure about when the judge decides pretty sure it was a ruling like 14 or 30 days after all the briefs are in looks like I made typo Jan 18th is when Al Hodges could follow up with another optional reply if needed so perhaps the clock starts ticking on waiting for a Judges ruling after Jan 18th, bottom line is we can now follow the court case as these have only been the correct and accurate deadlines that have ever been meet, since all the guru's are still batting triple zero .000
