Feb 29th, 2012 Judge again denies the SEC/DOJ the renewed motion for summary affirmance of this appeal is DENIED.
Judge states: “ because the arguments raised in the opening brief are Sufficiently Substancial to warrant further considerations by a merits panel. says the Defendants brief due 30 days from this date Feb 29th, 2012.
Mar 22nd, 2012 Again SEC/DOJ Lawyer Keith Staub asks Al Hodges and the court for a 30 day extension. Al Hodges agrees to give then the 30 day extension again.
April 30th, 2012 SEC/DOJ Lawyer Keith Staub finally files the answering brief on the last day, last hour, last minute on April 30th, 2012
on May 14th, 2012 Al Hodges has the option to respond. Wether he does or not
After the 14 days pass from that answering brief dated April 30th, 2012 it will now be in the hands of the Judge to decide if the case goes to a trial or he dismisses the case.
If dismissed by the Judge, Al Hodges next move will to Appeal to the Supreme Court.
