About those signatures...I'm just asking...
« Thread Started on Today at 5:49pm »
Sunday night in the ProCMKX room (mona's room) we were discussing the signatures on the Motion to Enlarge and the TRO documents. It appears (rather easily) that Kevin West's signature is very different between the two. I asked one of the leading Forensic Document Examiners in the country to compare the two and tell me if there was any chance the same person signed them. Additionally, there are three initials next to one of the signtures possibly indicating that the document may have been signed by someone on behalf of Kevin. I wondered if this can be legally done in this case.
Here is the reply:
The "Kevin M. West" and "Kevin West" signatures were NOT written by one and the same person.
The notary's statement affirms that the person who was present before him (or her) and signed the document, "Kevin M. West", on April 19, 2007 IS Kevin West.
Regarding the initials following the "Kevin West" signature, I don't know why they are included. Is there a notary statement that affirms presence of the person who wrote the "Kevin West" signature on the document dated August 23, 2007? Usually, it is customary for the notary to request identification from the person signing the document.
The question you have regarding someone signing a document on the behalf of another person is valid and should be further addressed.
- Who is the person that claims to have permission to sign Kevin West's signature on this or any other document?
- The notary should confirm whether that person,by name, was in his presence when signing the document.
- The person who wrote the "Kevin West" signature (with subsequent initials) should be required to provide documented proof that such permission had been given to him. It should specify whether the permission is granted for signing any document at any time, or for a specific document only.
And now you know.

For those wanting to look at the signatures, here are some of the links for quick reference

Now go back and look at the Motion to Enlarge, exhibits A and G. You will see that the signature for Stan McGrue is also VERY different and NOT one and the same person. BOTH are notarized. A father and son of the same name perhaps? Well, only ONE license number (1190) and both have the same middle initial, W. It is customary to only use your middle initial in your signature and not on documents or personal checks as means of providing yet another way to verify which is your signature.
Now, because these two are vastly different--was there really an attempt to serve Urban? I am not suggesting someone is not telling us the truth because I honestly don't know. But I do know that these are not the signatures of one person, so something doesn't add up.
And the point worth noting is that the signature on the Motion to Enlarge was NOT notarized, nor is it the signature of Kevin West. Also, please note that this signature was on the Declaration by Kevin West. How can one make a declaration and not sign it?

Hey Mr. Cloak & Dagger, here's a thought...Ask Kevin or Bill what's up. You're not dealing with Urban, it's part of the Plam, Casavant here.....
When the heck are you guys gonna stop acting like children and grow a set big enough to go to the source?
If your inference is directed at me, then you've missed the point completely. There is nothing cloak & dagger about signatures that are not by the same person, yet claim to verify information as being true. Moreover, there appears to be something criminal in a Notary that signed as verifying the signature of someone who supposedly attempts to serve someone important in our "case" against, and yet those signatures are not of the same person. It is simply not right and shareholder shouldn't have to follow up on these kinds of things if everyone involved is above reproach. Furthermore, there is nothing childish in this information and/or the questions that result. Diverting attention from the differentiation of signatures doesn't negate the obvious challenges this presents.
If on the other hand your comments were directed at me, I'm sorry.

Have you ever heard of "Power of Attorney?"
That might explain the different KW signatures, MIGHT. You see, most of the time the POA signs their own name not someone else's. Of all people on the boards g2g, I would have thought you would have known that. As for the two different sigs from those trying to serve UC, the POA angle doesn't hold water at all.
