Any ideas why Penson Financial would not provide me with my cert? I tried requesting them from MyTrack Data to no avail. So I contacted their clearing house and Penson told me that they have a cert for 117 million but they could not break it up due to the company has declined their request.
With that said Kevin doesn't that affect a shareholder trying to get their certs?

I trust all is well for you and your family.
I have NEVER declined to transfer a cert for any firm trying to cert out a shareholder, this I would think goes without saying.
It would be prudent for you to send me a copy of all of your written correspondence back and forth with your broker showing your request and their response(s). I would also demand that they send you a copy of the denial. (which I know they do not have)

Well, that is very contradicting because the company has already stated it froze the TA from doing any transactions so that really makes no sense. Now if Kevin expects the brokers to jump through hoops to get this done then he is crazy. They send the request to the TA and the TA is telling them they can't break up the certs without the companies permission and sends it back then do you really expect the broker to try and hunt down Kevin for permission? But then Kevin has also already stated many times that they were not doing bulk cert transactions which this is what this would be.

What I find interesting is that Mark updated us on this recently as if some impropriety existed within the request made by a brokerage firm to break down a lage cert. Here is what Mark wrote:
"CMKM Diamonds, Inc. has received letters from a broker requesting that larger CMKX certificates (held in the same broker's name) be broken down into several smaller certs. The written request contained the notation "FOR FAILS PHY". The broker confirmed that the request was to cover a fails to deliver in the stock. "
Kevin wrote that he "NEVER declined to transfer a cert for any firm trying to cert out a shareholder..."
Penson wrote that they were denied their request to break the cert down.
Now, who is bullshi*ing who here?

I agree it did. I know that Overstock has a fail problem because the facts show it. The same facts show CMKX doesn't have a fail problem.
You can't have it both ways. Hold up the reprot and say see the report shows Overstock has fails 8 million over the O/S then the same report that shows CMKX has little fails say that it is wrong. Either the report is right or wrong.

f. Jonas is a friendly. He has been here consistently for good reason. Look at him as the anti-Adobe. The story line here is akin to a made for TV Vince McMahon scenario.
